Agreeing to these terms

These terms cover your use of the True North Malibu Concrete website and any estimate or work you ask us for. By using the site, requesting an estimate or booking a job, you agree to them. If you don't agree, please don't use the site or our services.

When we sign a written contract or proposal for your job, that document controls the work. Where it differs from these terms, the signed contract wins.

What we do

True North Malibu Concrete is a concrete contractor in Malibu, CA. We build and repair driveways, patios, sidewalks, steps, pool decks, garage floors, retaining walls, footings and foundations. We also do stamped and decorative concrete and concrete cutting for homes in Malibu and the cities around it. You'll find the full list of services on our home page, and you can read more about how we work on our About page.

What's on this website is general information about the trade. It isn't a promise of a particular result on your property, because every job depends on the soil, the slope, the access and the old concrete we find there. We're fully licensed and insured.

Estimates and pricing

Estimates are free, we do them at your property, and you're under no obligation to hire us. An estimate is our best figure for the work it describes, based on what we can see and measure on the day we visit, and it's good for the period written on it because material prices move.

The price can change if you change the scope, or if we find something nobody could see until the old slab came out, like soft or wet subgrade, which is the soil the new slab sits on, buried roots or old pipes. When that happens, we show you what we found and agree on any change in writing before we do the extra work.

Scheduling, weather and cancellation

We set the pour date around the weather, because rain or hard heat on fresh concrete can leave a weak, dusty surface. If conditions aren't right, we may move your date and will tell you as early as we can. A weather delay isn't a breach by either of us.

You agree to give our crew clear access to the work area and to tell us about anything buried we should know about, like sprinkler lines, drain pipes or private utility lines. After the pour, keep people, pets and vehicles off the new concrete for the time we give you, because curing, the wait while concrete gains strength, can't be rushed. Damage from using the slab early isn't covered.

If you need to cancel or reschedule, call us as soon as you know. Once we've ordered materials, booked a concrete delivery or started work, you may owe those costs as set out in your contract. Nothing here takes away any right to cancel that California law gives you.

Payment

Your contract spells out any deposit, any progress payments and when the balance is due. We accept the payment methods listed on your invoice.

If a payment is overdue, we may pause work until it's paid, and any late fee in your contract may apply. We keep every collection and lien right the law gives a contractor.

What we can and can't promise about concrete

Concrete can crack even when it's placed right, so we can't promise a slab will never crack. We cut control joints, grooves that give the slab a planned place to crack, so that cracking usually shows up in those straight lines instead of across the middle.

Hairline cracks, slight color differences between pours, and natural variation in a broom finish, the light texture that keeps a slab from getting slick, or in a stamped pattern are normal and aren't defects. Any warranty on our work is the one written in your contract. Beyond that, and as far as the law allows, the website and our services come without any other warranty, express or implied.

We don't cover damage caused by soil settling under areas we didn't prepare, water draining onto the slab from somewhere else, harsh chemicals, loads heavier than the slab was built for, or changes someone else makes later. If something about our work doesn't look right to you, call us and we'll come out and look at it.

Limits on our liability

As far as California law allows, True North Malibu Concrete isn't responsible for indirect or consequential losses, such as lost use of your driveway or lost income. Our total liability for any claim about a job is limited to the amount you paid us for that job.

These limits don't apply where the law doesn't allow a business to limit its liability.

Using this website

We try to keep the information here accurate and current, but it can change without notice and shouldn't replace advice about your own property. Links to other websites are for your convenience, and we're not responsible for what's on them.

Our contact form is run by an outside form service. Please don't send payment card numbers or other sensitive details through it.

If we disagree about a job

Call us first at (424) 388-5404 or reach us through our Contact page, because most problems get settled by walking the job together. If that doesn't settle it, we each agree to try mediation in good faith before going to court.

If the dispute still isn't settled, either of us may take it to a court with jurisdiction in the county where the work was done.

California law applies

These terms, your use of this website and any work we do are governed by the laws of the State of California.

Changes to these terms

We may update these terms from time to time and will post the new version on this page. The version posted when you request an estimate or sign a contract is the one that applies to that job.
